תנאי שימוש אלו ("התנאים") מסדירים את השימוש בשירות BetterScan ("השירות", "אנחנו", "אנו"). השימוש בשירות מהווה הסכמה מפורשת ובלתי-חוזרת לכל סעיפי תנאים אלו. אם אינכם מסכימים לתנאי כלשהו — אל תשתמשו בשירות.
1. מתן השירות "כפי שהוא"
השירות מסופק "כפי שהוא" (AS-IS) ו"ככל שזמין" (AS-AVAILABLE), ללא כל אחריות מכל סוג שהוא, מפורשת או משתמעת, לרבות, אך לא רק, אחריות לסחירות, התאמה למטרה מסוימת, אי-הפרה, דיוק, שלמות או זמינות.
2. שלילת אחריות גורפת
בשום מקרה לא נישא באחריות לכל נזק שהוא, לרבות אך לא רק נזק ישיר, עקיף, מקרי, תוצאתי, מיוחד, עונשי או למופת, אובדן רווחים, אובדן הזדמנויות, אובדן מידע, אובדן מוניטין, או כל נזק אחר, בין אם נבע מחוזה, נזיקין, רשלנות, אחריות מוחלטת או כל בסיס משפטי אחר, גם אם הוזהרנו על אפשרות לנזק כזה.
3. תקרת אחריות
בכל מקרה, אחריותנו המצרפית, מכל סיבה שהיא, מוגבלת לסך של 0 (אפס) שקלים חדשים או לסכום הנמוך ביותר המותר על פי דין — הגבוה מבין השניים.
4. שיפוי
אתם מתחייבים לשפות, להגן ולפטור אותנו, וכל מי מטעמנו, מפני כל תביעה, דרישה, חבות, נזק, הוצאה ושכר טרחת עורכי דין, הנובעים מהשימוש שלכם בשירות, מהתוכן שאתם מעלים, מהפרת תנאים אלו, או מהפרת זכויות צד שלישי כלשהו (לרבות פרטיות, זכויות יוצרים, סימני מסחר, סוד מסחרי, לשון הרע וכל זכות אחרת).
5. דיוק חילוץ הנתונים
השירות מבצע חילוץ אוטומטי של נתונים מתמונות באמצעות בינה מלאכותית. תוצאות החילוץ עלולות להיות שגויות, חלקיות או חסרות. אתם, ואתם בלבד, אחראים לוודא את נכונות הנתונים. איננו נושאים בשום אחריות לכל פעולה, החלטה, נזק או הפסד הנובעים משימוש בנתונים שחולצו.
6. השעיה, ביטול וסיום
אנו רשאים בכל רגע, לפי שיקול דעתנו הבלעדי, ללא צורך בסיבה והודעה מוקדמת: להפסיק את השירות; להשעות, להסיר, לחסום, או למחוק כל גישה או חשבון; להסיר או למחוק כל תוכן; לשנות, להגביל או להפסיק תכונות; או להעביר את השירות לבעלות אחרת. אין באפשרות פעולות אלה כדי להקים זכות לפיצוי מכל סוג.
7. מחיקת מידע
אנו רשאים למחוק כל מידע ובכלל זאת תוכן שהעליתם, בכל רגע, ללא הודעה, ללא חובת שיחזור וללא חובת פיצוי. אובדן או השמדת מידע אינו עילה לתביעה.
8. צד שלישי
השירות עשוי לשלוח את התוכן שאתם מעלים לעיבוד אצל ספקי צד שלישי. אנו אין אחריות לפעולותיהם, לאבטחתם, או למדיניות הפרטיות שלהם. השימוש בשירות מהווה הסכמה מפורשת לשליחה כאמור.
9. ויתור על תובענה ייצוגית ועל מושבעים
במלוא ההיקף המותר על פי דין, אתם מוותרים על זכותכם להגיש או להצטרף לתובענה ייצוגית, לקונסולידציה של תביעות, ולמשפט בפני חבר מושבעים. כל מחלוקת תידון כתביעה אישית בלבד.
10. דין שולט וסמכות שיפוט
תנאים אלו כפופים לדין הישראלי בלבד. סמכות השיפוט הייחודית והבלעדית בכל מחלוקת הקשורה לתנאים או לשירות מוקנית לבתי המשפט המוסמכים בתל אביב-יפו, בלבד.
11. כוח עליון
איננו אחראים לכשל או עיכוב הנובעים מנסיבות שאינן בשליטתנו, לרבות פעולות ממשלה, מלחמה, פיגוע, מגיפה, אסון טבע, תקלת רשת, פריצה, כשל של ספק, חוק חדש ועוד.
12. הפרדה (Severability) ואי-ויתור
אם סעיף כלשהו ייפסל כלא תקף — שאר הסעיפים יישארו בתוקף מלא. ויתור על זכות כלשהי לא ייחשב כויתור על אותה זכות במקרים אחרים או על זכויות אחרות.
13. הסכם שלם
תנאים אלו, יחד עם מדיניות הפרטיות, מהווים את ההסכם השלם בינינו ומחליפים כל מצג, הבנה או הסכם קודם.
14. העברת זכויות
איננכם רשאים להמחות או להעביר את זכויותיכם או חובותיכם לפי תנאים אלו ללא הסכמתנו מראש ובכתב. אנו רשאים להמחות, למכור, להעביר או למזג את השירות בכל רגע, ללא הודעה.
15. שינויים בתנאים
אנו רשאים לשנות תנאים אלו בכל רגע ללא הודעה מוקדמת. הגרסה המעודכנת תופיע בעמוד זה ותחול מיד עם פרסומה. המשך שימוש בשירות מהווה הסכמה לשינוי.
16. גיל וכשרות
אתם מצהירים כי הנכם בני 18 ומעלה, בעלי כשרות משפטית מלאה, ומורשים להעלות כל תוכן שאתם מעלים לשירות.
17. בעלות על תוכן
אתם מתחייבים שיש לכם את כל הזכויות הדרושות לתוכן שאתם מעלים. אתם מעניקים לנו רישיון בלתי-מוגבל, חינם, נצחי, בלתי-חוזר, סובלני, גלובלי, להעתיק, לעבד, לאחסן, לשנות, להציג, לחלץ נתונים, להשתמש לצורך פיתוח ואימון מודלים, ולכל מטרה אחרת לפי שיקול דעתנו הבלעדי.
18. ויתור על זכויות מוסריות
במלוא ההיקף המותר על פי דין, אתם מוותרים על כל זכות מוסרית בתוכן שהעליתם.
19. אין שותפות
תנאים אלו אינם יוצרים שותפות, יחסי עובד-מעביד, סוכנות או נציגות. אין צד שלישי הנהנה מתנאים אלו.
20. מחלוקות
כל מחלוקת או טענה כלפינו חייבת להישלח אלינו בכתב בתוך 30 יום מקרות העילה, אחרת תיחשב כויתור.
21. הודעות
הודעות אלינו יישלחו בכתב, ולא ייחשבו שנמסרו עד שאישרנו אותן בכתב. הודעות אליכם, לרבות שינויים בתנאים, יבוצעו על ידי פרסום בעמוד זה והדבר ייחשב כמסירה תקפה.

These Terms of Use ("Terms") govern use of the BetterScan service ("Service", "we", "us"). By using the Service you give your express, irrevocable consent to every clause. If you do not agree with any clause — do not use the Service.
1. AS-IS / AS-AVAILABLE
The Service is provided "AS IS" and "AS AVAILABLE", without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness or availability.
2. Disclaimer of liability
In no event shall we be liable for any damages whatsoever, including but not limited to direct, indirect, incidental, consequential, special, punitive or exemplary damages, lost profits, lost opportunities, lost data, lost goodwill or any other damages, whether based in contract, tort, negligence, strict liability or any other legal theory, even if advised of the possibility of such damage.
3. Liability cap
Our aggregate liability for any cause whatsoever is capped at the higher of: zero (0) New Israeli Shekels and the lowest amount permitted by applicable law.
4. Indemnification
You agree to indemnify, defend and hold us, our affiliates and our personnel harmless from and against any and all claims, demands, liabilities, damages, costs, expenses and attorneys' fees arising from or related to your use of the Service, content you upload, your breach of these Terms or your violation of any third-party right (including privacy, copyright, trademark, trade secret, defamation, or any other right).
5. Accuracy of extraction
The Service performs automated extraction of data from images using artificial intelligence. Results may be wrong, incomplete or missing. You, and you alone, are responsible for verifying their accuracy. We accept no responsibility for any action, decision, damage or loss arising from use of extracted data.
6. Suspension and termination
We may at any time, in our sole discretion, without cause and without notice: discontinue the Service; suspend, remove, block or delete any access or account; remove or delete any content; modify, restrict or terminate features; or transfer ownership of the Service. None of these actions creates any right of compensation.
7. Data deletion
We may delete any information, including content you uploaded, at any time without notice, without obligation to restore it, and without compensation. Loss or destruction of data does not give rise to any claim.
8. Third parties
The Service may transmit content you upload for processing to third-party providers. We accept no responsibility for their actions, security or privacy practices. Use of the Service constitutes express consent to such transmission.
9. Class-action and jury-trial waiver
To the maximum extent permitted by law, you waive your right to file or join any class action, consolidate claims, or have a jury trial. Disputes shall be resolved on an individual basis only.
10. Governing law and jurisdiction
These Terms are governed by Israeli law exclusively. Exclusive jurisdiction over any dispute lies with the courts of Tel Aviv-Jaffa, and no other court.
11. Force majeure
We are not responsible for any failure or delay caused by circumstances beyond our control, including government action, war, terrorism, pandemic, natural disaster, network failure, intrusion, supplier failure, or new law.
12. Severability and no-waiver
If any clause is held invalid, the remaining clauses remain in full force. A waiver of any right is not a waiver in other instances or of other rights.
13. Entire agreement
These Terms together with the Privacy Policy are the entire agreement and supersede any prior representation, understanding or agreement.
14. Assignment
You may not assign or transfer your rights or obligations without our prior written consent. We may assign, sell, transfer or merge the Service at any time without notice.
15. Changes
We may change these Terms at any time without notice. The updated version appears on this page and takes effect immediately. Continued use constitutes acceptance.
16. Age and capacity
You represent that you are 18 or older, of full legal capacity, and authorised to upload any content you upload.
17. Ownership of content
You represent that you have all rights necessary in any content you upload. You grant us an unlimited, royalty-free, perpetual, irrevocable, sublicensable, worldwide licence to copy, process, store, modify, display, extract data from, use for development and training of AI models, and any other purpose at our sole discretion.
18. Moral rights waiver
To the maximum extent permitted by law, you waive any and all moral rights in content you upload.
19. No partnership
These Terms do not create any partnership, employment, agency or representation relationship. There are no third-party beneficiaries.
20. Disputes
Any dispute or claim must be sent to us in writing within 30 days of the cause arising; otherwise it is waived.
21. Notices
Notices to us must be in writing and are not deemed delivered until acknowledged by us in writing. Notices to you, including changes to these Terms, are effected by publication on this page and shall constitute valid delivery.
